Workplace Accommodation
Employers have a duty to accommodate disabled employees up to the point of undue hardship, which is a paramount obligation pursuant to human rights legislation, and recent legislation outlined in The Accessibility for Manitobans Act. MHC occupational therapists assist employers and unions with navigating the legislation regarding physical or mental disability.
May first require a Functional Capacity Evaluation (FCE) to objectively determine the individual’s safe functional capabilities, and a Job Demands Analysis (JDA) to determine the demands of the essential job functions.
Accommodation can consist of the following:
- Graduated return to work
- Modified duties
- Flexible scheduling
- Ergonomic solutions
- Changes in supervision or work location
